Muneer End User License Agreement (EULA)

Please read the End User License Agreement, referred to herein as the EULA, as it sets forth the terms and conditions under which we license our systems and software at SharedTech.

The Muneer Platform, Muneer Toolbar, or products under the Muneer منير umbrella (the "Software") and the accompanying documentation are protected by copyright and intellectual property laws and treaties, as well as laws and treaties relating to other forms of intellectual property.

SharedTech, its parent company, affiliates, subsidiaries, and suppliers own all intellectual property rights in the Muneer Platform, code, plugins, website, tools, and servers.

Your use of the Muneer Software is subject to these rights and to all the terms and conditions contained in this End User License Agreement.

Acceptance

By using the Software, you agree to be bound by the terms and conditions of this End User License Agreement.

If you do not agree to this End User License Agreement, please stop now and delete all Muneer code or software from your websites, systems, and servers.

Before copying or downloading the Software or any code from the Muneer website, your use of any of them shall constitute express acceptance of the terms and conditions set forth in this End User License Agreement.

If you do not agree to this End User License Agreement, you must not download the Software or its code or use it for any purpose whatsoever.

Updates

SharedTech or Muneer reserves the right, at its sole discretion, to change or modify its software, website, user interface elements, plugin, or any code and to publish any changes generally to your website without prior notice to you.

Technical Support

Muneer has no obligation to provide any upgrades, technical information, or technical support of any kind.

Transfer Restrictions

You may not assign your rights or obligations under this End User License Agreement, or redistribute, pledge, sell, lease, sublicense, or otherwise transfer such rights.

Use Restrictions

You may not "reverse engineer," disassemble, or attempt to derive the source code of Muneer. Doing so exposes you to legal liability under intellectual property and copyright protection laws.

Modification Restrictions

You may not modify the Muneer Software or create any derivative work from Muneer, its website, user interface element, additional platforms and ancillary products, code, or any accompanying documentation.

You may not alter any files or libraries in any part of the Muneer Software.

You may not reproduce the Muneer database or create any copies of Muneer data.

Copying Restrictions

You may not copy or reproduce any part of the Muneer Software.

Ownership

Muneer retains all data, intellectual property rights, proprietary rights, and ownership in the Software and all copies thereof, including, without limitation, source code, documents, documentation, copyrights, patents, trademarks, trade secrets, trade names, titles, designs, methods of operation, updates, and others.

The Software is protected under copyright laws in the Kingdom of Saudi Arabia, the Gulf Arab States, international treaties and agreements, and other laws around the world.

Warranty

Muneer does not warrant compliance with WCAG standards.

Muneer interacts differently with each website, browser, and operating system and therefore makes no warranties or representations that the Software will operate as expected on your website.

If you or your users experience any technical issues, errors, or unexpected malfunctions, it is your responsibility to report such issues to [email protected], including the relevant screenshots, browser versions, operating system version, and device type.

If the Muneer Software changes the intended behavior of your website in any way or does not provide the expected accessibility enhancements, you may remove any Muneer code from your servers and discontinue use of the Software.

Limitation of Liability

Muneer does not warrant compliance with WCAG.

You are solely responsible for ensuring the accessibility of your website and testing its compatibility with WCAG 2.1 and 2.2 or other accessibility regulations as required by the applicable laws and regulations.

Furthermore, you hereby agree to test the Muneer tool and all of its accessibility features on your website locally before making it publicly available to ensure proper performance.

By choosing to use the Muneer tool, you hereby agree that all pages and content on your website have been tested using common browsers and operating systems and with all of Muneer's accessibility features (disability modes, dyslexia fonts, voice commands, contrast changes, text size changes, keyboard navigation, cursor size, link highlighting, font changes, desaturation, etc.) and that all available functions operate correctly.

Muneer shall in no way be liable to you or any third party claiming through or on your behalf for any difficulties or problems encountered.

As such, Muneer, its directors, officers, employees, agents, or any partner, affiliate, or solution provider shall in no way be liable to you or your users, and you hereby waive any direct, indirect, economic, financial, special, commercial, incidental, exemplary, or consequential damages, including, without limitation, lost profits, citations, loss of business revenue or profits, lost data, or damages resulting from errors, glitches, malfunctions, or failure to achieve the intended function, design, or content, arising out of or in connection with the use or performance of the Software, even if Muneer or an affiliate of SharedTech has been advised of the possibility of such damages.

You agree to indemnify and hold Muneer harmless from all claims, judgments, liabilities, expenses, or costs arising from any breach of this End User License Agreement and/or acts or omissions or oversights.

Disclaimer

This Software is licensed to you "as is," and SharedTech or Muneer disclaims any and all warranties, express or implied, including, without limitation, any implied warranties of merchantability or fitness for any particular purpose.

Without limiting the foregoing, Muneer makes no representations that use of the Software will not infringe any copyright, patent, trademark, or other rights owned by a third party.

Furthermore, and without limiting the foregoing, Muneer makes no warranties or representations that the Software will meet your requirements, that operation of the Software will be uninterrupted or error-free, or that it will not harm your computer or mobile device.

You are responsible for determining whether the Software and its results, if any, are suitable for you, your software, your website, your server, your product, and your computer or mobile device.

You must assume all risks with respect to the performance, operation, and quality of the Software.

Agreement Updates

SharedTech or Muneer reserves the right, at its sole discretion, to change, modify, add, or remove portions of the End User License Agreement, Terms of Use, or Privacy Policy at any time ("Updates").

You will be deemed to have accepted any Update by continuing to use SharedTech's software or services.

Waiver

Muneer's failure to assert or enforce any right contained in this End User License Agreement shall not constitute a waiver of that right.

EULA Agreement

This End User License Agreement constitutes the entire agreement between you and Muneer concerning the subject matter herein and supersedes any prior oral or written agreements, communications, representations, or undertakings, provided that this End User License Agreement agrees with the terms of the End User License Agreement and shall not supersede the Terms of Use, Privacy Policy, or Cookie Policy.

Jurisdiction

This End User License Agreement shall be governed by the laws and regulations of the Kingdom of Saudi Arabia.
